Welcome to my “Intimacy Game Plan” (the “Program”). This letter constitutes a legal agreement between us. Please read it carefully and raise any questions and concerns that you have before you sign it. You are encouraged to seek independent legal advice if you have any questions of a legal nature.

What is The Intimacy Game Plan?

I do not diagnose or treat mental or other health disorders. I do share my theories, opinions and encourage you to seek licensed counseling and professional medical care when you need. It is your responsibility to manage your own mental, and physical health including necessary exams and ongoing support. The Program should be seen as a supplement to such support, it should never be seen as a replacement for it.

In situations where you are under the care of a professional counselor or medical practitioner and conflict arises between the recommendations of those professionals and myself, I will defer to the professional’s judgment unless it is obviously destructive or potentially harmful, in which case I will encourage you to seek a second opinion.

I want to be fully effective for you. It is important that you are honest and transparent with me, including notifying me of any past or current mental, physical, or other conditions that may be affecting you. It is important that you remain open to accepting feedback and advice from me.

Benefits and Risks
Benefits: The Program you will learn how to explore and Share Sensual Pleasure® in a way that is right for you in your relationship/s. Be aware that this topic can bring up unexpected memories, emotions, or physical reactions. I provide lessons, and teach tools, for you to learn, practice, integrate and grow in your own relationship/s. I can not achieve your goals for you. I can not in any way guarantee that you will reach all of your relationship, sexual, intimacy, or life goals. Only you can do that. I offer guidance, support, and accountability.

You (or your partner) has had a 1:1 call with Amy Color Intimacy Coach.

Fees listed are in US dollars.

Materials
Video lessons, exercises, and printable downloads will be provided in the Members area on the website.

You understand, acknowledge, and agree that some services or components of the Program may require additional agreements, including websites and software, and that further agreements may be a condition of your participation in said components of the Program.

Confidentiality
I will protect the confidentiality of our communications. I will only release information about our work to others with your written permission, to my own confidential professional advisors such as my lawyer, or in response to a court order. Also, there are some situations in which I am legally obligated to breach confidentiality in order to protect you or others from harm. If I have information that indicates that someone is being abused, I must report that to the appropriate government agency. If a client is an imminent risk to him/herself or makes threats of imminent violence against another, I am required to take protective actions. These situations are quite rare in coaching practices. If such a situation occurs in our relationship, I will make every effort to discuss it with you before taking any action.

It is impossible to fully protect the confidentiality of information transmitted electronically. This is particularly true of e-mail and information stored on computers connected to the internet which do not utilize encryption and other forms of security protection. Keep this in mind.

You will protect and maintain the confidentiality of the other participants in the Program, and of any materials that I provide to you as part of the Program for your personal educational purposes, only. Any unauthorized copying or distribution of my materials without my written permission will result in legal action.

Liability Disclaimer
In summary, any advice that you receive from me should not be relied upon for personal, medical, legal, or financial decisions and you should consult appropriate licensed professionals with experience for specific advice tailored to your situation in each of these disciplines.

Also, to the maximum extent permitted by applicable law, in no event shall I or anyone affiliated with me be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, liability arising out of or in any way connected with or otherwise arising out of the use of the my coaching or educational services, or with any of my written publications including my books, whether based on contract, tort, negligence, strict liability or otherwise.

If you are dissatisfied with any portion of my coaching services or with any of these terms of use, your sole and exclusive remedy is to discontinue using my services immediately. You confirm that you have either sought independent legal advice regarding this letter’s contents or alternatively, you have waived the opportunity to do so voluntarily.

You hereby indemnify me, my company, and any of my authorized representatives against damages or the loss of access if you fail to maintain the confidentiality of your login or other participation credentials.

Termination
I am committed fostering a positive experience for all participants of The Program. Therefore I may, in my sole discretion, limit, suspend, or terminate your participation in the Program, or any portion thereof, including any online components, without any refunds if:

• You become disruptive or difficult to work with;

• You fail to follow the Program rules and guidelines; and/or

• You impair the participation of other participants in the Program.
